Contract and Guarantee
           

You, the Buyer, are responsible for regular veterinary care, including the remainder of the vaccinations, rabies vaccinations, and periodic worming.  All of our puppies are wormed at 2, 4, 6, and 8 weeks of age by our veterinarian or by me with record of purchase of medication from veterinarian. If a puppy stays longer then they are de-wormed every 2 weeks after until they are 12 weeks old. After which they are de-wormed every (3 months UPDATED: 10/31/19).

 

Breeder guarantees that all vaccinations and worming are current. A shot/health record is included with each puppy. The fact that this puppy has been vaccinated does not guarantee immunity. Puppy must receive a series of vaccinations that are given as recommended by your veterinarian. Take the health record and your puppy to the vet of your choice within 48 hours in order for the current health of the puppy to be established and to receive instructions on continuing care and vaccination schedule. The Breeder/seller does not guarantee the temperament of this Dane because it is the responsibility of the new owner to properly socialize and train.

 

The Breeder/seller does not guarantee: against skin problems such as puppy acne, demodectic mange, etc.  This also does not cover HOD, pano, OCD and growth related problems, and these are not genetic. This guarantee does not cover what in the breed Great Danes is considered normal: cherry eye, haw eyes, entropion, and torsion of a stomach. 

 

This guarantee does not include uneven bites, undescended testicles demodex mange, or umbilical hernias, fleas, ticks or ear mite, Coccidia and Kennel Cough, which is common in puppies that are shipped and usually caused by bacteria. Kennel Cough is self-limiting and like the common cold, it must run its course. Full recovery is expected and Kennel Cough on its own is not life threatening. This guarantee does not cover Parvo. They leaves us with its first shot. It is you the buyers responsibility to keep up to date on all proper vaccinations and not to socialize your puppy with other dogs, dog parks, pounds, humane society's and other places that your puppy could pick this disease up.

Show dog exception:  in the event of an uneven bite or undescended testicle, Breeder will exchange pup of equal value, sex and color when available.  If there is not a current pup available of the same bloodlines, or equal value, the breeder agrees to give a voucher towards a future litter agreed upon by Breeder and Buyer (Voucher is good on the next litter or up to one year from date of voucher UPDATED 10/31/19)

 

A returned puppy must be returned to the Seller in good condition, at the Buyer's expense. This includes shipping of the returned pup, and shipping of the replacement pup. The Buyer/owner will then qualify for a replacement puppy. 

The Breeder/seller does not guarantee the ears to stand, as it is the responsibility of the new owner to properly tape the ears and train them to stand. All the above warranties apply until the dog reaches two years of age. No guarantee or warranties to health related problems, caused by nutrition or care, nor any accident or illness once the pup is delivered. No veterinarian expenses, quarantine, freight, or shipping charges, etc. will be paid by the Breeder/ seller.

 

The health of our puppies is our main concern and sometimes delay in shipping may occur due to reasons beyond our control. Puppy will be released or sent to buyer only when Breeder/seller’s veterinarian gives their approval to do so. We ship puppies after 8 weeks of age. A puppy carrier and physical exam and health certificate by a licensed veterinarian are included when a puppy is shipped.

 

It is to be understood - the Buyer agrees to provide good care and a loving environment. You will be responsible to arrange to pick the puppy up upon its arrival at the airport. Risk of flying puppies is always a concern for us; so we want to make you, the customer, assume some of the risks involved. These risks are the responsibility of the customer.

 

Health Guarantee and Replacement  

 

Conditions:

Guarantees are non-transferable and valid for the original buyer only.

 

Every effort has been made to assure that the puppy you have selected is healthy on the date of delivery and that the puppy has received proper vaccinations and worming. The Buyer has been informed of these and of future vaccinations and  worming due, and he will agree to have them done on time, failure to do so,  will forfeit the buyers right to exchange the pup if buyer qualifies for the criteria to have a pup exchanged.  Buyer agrees to inform the seller/breeder what vet they plan to use within the 48 hours after receiving their pup as well as providing that vets phone number.

 

This puppy is guaranteed for 24 months against fatal and life altering congenital disease which adversely affects the health of the animal. This includes severe hip dysplasia, which hampers a dog's movement and natural gait and requires surgery to correct, heart, pancreas, and liver problems of a severe life threatening or altering nature.
         
If the dog suddenly dies within this 24 month time frame, the Buyer will pay to have an autopsy done to ascertain reason. (NO EXCEPTION)

If reason is congenital, of a severe life threatening or altering nature, the Seller will replace the puppy with one of equal value.

A puppy showing any serious genetic or congenital defect will be replaced as follows:

Animal must show the defect up to 24 months of age. Seller must be notified of the problem within two (2) business days of the licensed veterinarian's determination and have two reports from two unassociated veterinarians stating the same problem and Seller will provide a replacement puppy of equivalent value. 

A puppy with a defect must be returned or euthanized with the prior permission of the Seller to qualify for a replacement puppy.

No refund, in part or in full, will be given.

Seller will not be responsible for any medical expenses incurred.

Buyer is aware that owning a puppy means trips to the veterinarian and understands that he/she will be responsible for all payments. 

All items covered under this guarantee are by replacement only. We do not give refunds.
              
A returned puppy must be returned to the Seller in good condition, other than the specified problem, at the Buyer's expense. This includes shipping of the returned pup, and shipping of the replacement pup. The Buyer/owner will then qualify for a replacement puppy. Buyer is responsible for ALL transportation costs to and from the Seller on a replacement puppy.

 

No replacement puppy will be given if he puppy has been bred, spayed, neutered, or euthanized without Seller's permission. 

Replacement puppy will be mutually agreed upon by both parties and will be of comparable quality. It is understood that the replacement puppy may not be from the exact same parents of original puppy. 

 

This guarantee applies to the original puppy only and is nontransferable to a second party. There are certain disorders that may be caused by environmental factors, for example: allergies, thyroid dysfunction, demodectic mange, and other autoimmune disorders that are not covered by this guarantee.

Any physical problem, which is or could be the result of injury, is not covered under this guarantee.

All the puppies sold as pets on a limited registration are required to be spayed or neutered by (18) months of age, after doing this the buyer must send the seller a copy of the receipt signed by the vet.

 

There will be no cash refunds—No exceptions. 

 

We reserve the right to check up on our pups and see how they are doing at any time.  The buyer agrees to respond to a wellness check up within 7 days and provide a picture of the wellbeing of the pup.  If a response is not made within 7 days, a reminder will be sent out that a breach of contract has been made and an additional 7 days is given to respond.  After which, no response by the buyer is made than legal action may be taken to get the dog back and a 500.00 fine added.  It is the buyers responsibility to keep up to date contact information to the seller (Delightful D's Danes).  We use the contact information used on the puppy application. 

Any breeding consideration shall not take place until the puppy has reached the age of two (2) years old.  

 

If a breeding takes place before the pup is 2 years of age the buyer agrees to return the pup promptly (before the dam whelps), sign over ownership to Delightful D's Danes, and agrees to cover any and all vet expenses as well as all other expenses dealing with the dam and the puppies that occur, until all pups of the litter find homes place by Delightful D's Danes.  Expected expenses are shots, deworming, microchipping, vet examinations, puppy care package outlined in Delightful D's Danes policies, dog food, x-rays, akc paperwork etc.  A detail of expenses occured will be recorded and supplied.  Unexpected expenses will be those that occur with the dam during pregnacy, such expenses are those of needed surgury for delivery of pups (c-section or medication), one of the pups needing emergency care, etc. A fine of 500.00 is also added to the final expense.  The buyer also agrees to supply information about who the sire is, his pedigree as well as contact information and medical history if known. Delightful D's Danes is not responsible for any agreements or arrangements between the buyer of the dam and the owner of the sire. 

The buyer agrees not to begin strenuous exercise and physical training with the puppy until the puppy has reached a minimum age of eighteen (18) months. This is to prevent damage to the puppy during formative stages.  

Any surgeries performed on the puppy, including the cropping of ears, spaying and neutering, resulting in death or an incapacitation condition is the sole responsibility of the buyer and the buyer alone.

 

The seller shall not be held responsible for the acts of the puppy after it leaves the sellers premise. The seller shall not be held responsible for the development of non-genetically derived faults, diseases, or disorders after the puppy leaves the seller. 

If for any reason the buyer is unable to keep a Delightful D's Dane, it is to be returned to the seller.  Under no circumstances is it to be taken to the pound, or and SPCA.  The Seller is willing to take the Dane back. Seller will never give money back under these circumstances. Shipping charges to return the pup to the seller is the responsibility of the buyer. Our dogs are not for resale by the buyer. If caught by Delightful D’s Danes (Delilah Quintana) there will be a Trip to court and a $3000 fee.

Both parties recognize that any dispute over this contract must be handled within the jurisdiction of Marion County, Oregon.  The buyer is responsible for any and all court assessed costs to settle the dispute. Both parties also acknowledge that the buyer will pay for any claims for lost wages on the part of the seller as a result of court proceedings.  

 

Our Wait List and Deposit Policy

Here's how our waiting list work. If you contact us by email or phone, your name will be placed below-NO DEPOSIT REQUIRED AT THIS TIME. Once puppies are born, we will contact you for a $350 deposit and your commitment. Deposits are to be paid by the time the pup reaches 2 weeks old to remain on the wait list for pick of the litter with a first come first serve bases.  When pups reaches 5 weeks old is when picks can be made.  First pick has 24 hours from day 35 after pups born to make a pick. Second pick has 24 hours after being notified the first pick has been made and so forth. With full payment paid by when puppies is 8 weeks of age. If total payment has not been received by 8 weeks (56 days) after puppies are born then you will lose your spot of first come first serve. You will then have an extended 3 days to pay the balance. If by that time full payment hasn't been received then the puppy will be listed for sale again. No refund is given. Review our refund polices. The deposits are non-refundable and will be applied to the final cost of your puppy. (Military and Law Enforcement Family's: be sure to mention this in your application process to receive a 10% discount on the price of the puppy you pick. We appricate everything you do for our country and community) The waiting list  is in order of when you requested your name on the list.

 
Our puppies range from 1600 to 2500. Depending on full or limited registration, male or female, color markings, and show potential. Prices for pups will be made when pups reach 5 weeks of age.  Remaining balance is due at when pups reach 8 weeks old and ready for pick up. If balance is not paid by then it is up to the seller to extend a grace period to the buyer if clear communication has been established. We have a no refund policy but if partial payment is received and buyer is unable to pay remaining balance then the partial payment will be forwarded to the price of the next litter if all puppies are sold.

UPDATE: (10/15/16) In the event of a congenital defect where the buyer wishes to keep the dog and the defect falls under the health guarantee warranty within the 24 month time frame than the seller (Delightful D's Danes) will reimburse the cost of the surgery and medication to correct the defect or illness. The buyer will need to disclose the defect right away (within 2 days of a vets findings) and allow the seller to have access to the medical history of the pup. This means the name of the vet and the phone number needs to be provided to the seller. It is the buyers responsibility to cover exam costs as this would be considered normal concern care in a pup and part of being a responsible pet owners. Pup will need to be examined by two separate vet clinics to confirm findings. If the second vet clinic confirms it is medically necessary to fix the health related issue covered on our health guarantee right away than we will reimburse the exam for the second vet clinic and cover the cost of care related to the health issue up until 24 months of age. If we determine that the health issue is too severe for the pup to sustain a normal life and that it would cause the pup more harm than we will require the pup the pup to be returned or euthanized. This is the only type of situation the pup will be returned at the cost of the seller. And the buyer will than be given a voucher for an exchange pup. The second vets finding must confirm that medical attention is needed right away for us to reimburse any costs. If it is not medically necessary to fix right away than the vet exams are the responsibility of the buyer. It is the buyers responsibility to send the seller a detailed itemized invoice of what was done and the costs. Once received by the seller, the seller than will have 30 days to reimburse the buyer. The seller will reimburse health issues covered under the warranty up until the pup is 24 months of age. If the buyer has not sent out proper paperwork for reimbursement by the time the pup reaches 24 months of age than the buyer forfeits reimbursement costs.  
 
UPDATE: (10-29-16) This wait list and deposit policy is only for when we have  a pick of the litter pending. If pups are listed with prices than deposits for specific pups are due and not held for pick of the litter.  The deposit will hold your pup until 8 weeks of age (no more than 10 weeks of age) until full payment is received or a payment plan has been already discussed.  If full payment has not been received by the buyer by the time the puppy has reached 10 weeks of age than the buyer forfeits the sale and the pup will be up for sale again.  NO DEPOSITS ARE REFUNDED but they can be applied to another puppy or to a future litter.  
 
UPDATE: (10-31-19) As from this date forward any vouchers given or previously given that have not yet been redeemed will automatically have an expiration date one year from the date they are given or from Oct 31st 2019, whichever is greater. If voucher is not redeemed within that year time frame than the voucher is void and holds no value. It is the responsibility of the voucher holder to use the voucher within a timely manner. Delightful D's Danes will produce at least one litter a year. No pending holds on pups are allowed for voucher holders. Once a pup is selected we will consider that pup adopted and voucher used. If there is a balance due than full payment is expected by the time the pup is 7 weeks old. If no payment is received the pup will go back up for adoption. NO EXCEPTIONS.  If the voucher holders for any reason, (family emergency, moving, expecting a new family member, etc.) changes their mind after redeeming the voucher, they WILL NOT BE ISSUED ANOTHER VOUCHER.  Because we do not place pending holds on voucher holders, we will however give the voucher holder up until the pups are 7 days old to make a selection from available pups before we start accepting deposits and holds from non voucher holders.
